Cañon City triple murder suspect in court for motions hearing

The man suspected of murdering three people in Canon City was in court on Monday (4/28/14) for a motions hearing.

CAÑON CITY, Colorado -

The man suspected of murdering three people in Cañon City was in court on Monday (4/28/14) for a motions hearing.

Jaacob Van Winkle, 31, is facing charges of murder, kidnapping, child abuse resulting in death, and sexual assault.   

The victims were 35-year-old Mandy Folsom and her two children, five-year-old Mason and nine-year-old Marissa. Authorities say Van Winkle was a friend of the family and lived with them. A teen daughter was the only survivor.

The murders happened on March 9 at the family's home on Phay Avenue. That is where officers found the victims' bodies and where police arrested Van Winkle.

Part of Monday's hearing focused on getting Van Winkle's fingerprints as evidence.

"The District Attorney's Office filed a motion requesting that the court order that the law enforcement agency be allowed to collect a full set of fingerprints from the defendant. The defense council filed an objection to that request and the judge is going to issue a ruling,” said Thom LeDoux, District Attorney for Colorado’s 11th District.

The judge will make that decision in writing by the end of the week

The defense said in court on Monday it will request for Van Winkle to post bail, but the District Attorney's Office will have a chance to prove why van winkle should be held without bail.

"For these types of crimes, an individual can be held without bail if the people can establish that there's proof evident and presumption great,” said LeDoux.

Van Winkle will be back in court on June 30 for a preliminary hearing and proof evident hearing.
